Si la agresión descrita en la sec. 5162 de este título, Agresión grave, es causada a propósito, con conocimiento o temerariamente, como consecuencia de una perturbación mental o emocional suficiente para la cual hay una explicación o excusa razonable o súbita pendencia, será sancionada con pena de reclusión por un término fijo de ocho (8) años si se ocasiona una lesión mutilante, o de tres (3) años si se requiere hospitalización o tratamiento prolongado.
