Extreme Risk Protection Orders (to remove firearms)

An extreme risk protection order is a civil court order that prohibits a person from:

  • having firearms in his/her custody or control; and
  • purchasing or receiving a firearm.1

Judges can issue extreme risk protection orders in certain situations where a respondent poses an extreme risk of causing harm to himself/herself or another person by:

  • purchasing, possessing, or receiving a dangerous weapon; or
  • having a dangerous weapon within his /her custody or control.1

The petition to request an order can be filed by a prosecutor, either the State’s Attorney or the Office of the Attorney General.1
