I have a protection order against the abuser. Can they have or buy a gun?

Nebraska state law says that the abuser cannot have a firearm when they have any of the following against them, and they are knowingly violating it:

  • a domestic abuse protection order;
  • a harassment order;
  • a sexual assault protection order; or
  • an equivalent order from another state.1

A Nebraska judge can include this restriction in an ex parte or a final domestic abuse protection order.2 If this is something that you want in your order, you may want to specifically mention in your petition that the abuser has firearms in their possession and that you want the judge to order them to be removed.
