We added a Litigation Abuse page in North Dakota based on a new 2023 law that allows someone dealing with abusive litigation to request an order restrictive abusive litigation, including the five following questions:
- What is the definition of abusive litigation in North Dakota?
- What can a judge include in an order restricting abusive litigation?
- Am I eligible to request an order restricting abusive litigation?
- How do I request an order restricting abusive litigation? Are there forms available to help me?
- My request for an order restricting abusive litigation was denied. What will happen next?
We added a new question titled “Is there anything I can do if my abusive partner continually files court proceedings against me?” in our Custody, Divorce, Domestic Violence Protection Orders, and Disorderly Conduct Restraining Orders sections to help victims of abusive litigation learn about this new remedy.
We also added six new statutes related to litigation abuse on our Selected North Dakota Statutes page.
