V filed for divorce; asks if can take child out of state for weekend (info on automatic temporary restraining orders)
In many states, once a divorce petition is filed, an automatic temporary restraining order goes into place that prohibits the parties from doing certain acts such as transferring assets, removing a spouse from health insurance, and taking the child out of the jurisdiction (the state). The orders apply to both spouses and are usually written on the petition or on other forms that are served with the divorce. [SEE IF YOU CAN FIND THE DIVORCE FORMS ON THE COURTS WEBSITE AND SEE IF THEY HAVE ANY AUTOMATIC ORDERS WRITTEN ON THEM THAT YOU CAN LINK HER TO. I WROTE THIS FOR TEXAS: I tried to look on the Texas Courts website to see if they list the divorce forms that are served with a divorce so I could see if the automatic orders prohibit removing a child from the jurisdiction - however, the Courts website only lists divorce forms for people without children. (see here: http://www.txcourts.gov/rules-forms/forms/)]
To find out for sure whether or not you can legally take your children out of state while the divorce is going on, you may want to talk to a divorce lawyer in STATE - we link to lawyers, some of which are free or low-cost here: LINK If you are not able to talk to a lawyer, you may be able to call the court clerk where you filed for divorce to ask for copies of any automatic temporary orders that go into effect once a divorce is filed.
