.Is fault (DV, adultery) held against A in divorce? (NY-specific)

THIS IS NY-SPECIFIC ONLY

In NY, adultery generally may not have an affect on custody unless by committing the adultery, a party somehow put his/her children at risk, in danger, or neglected them in some way.  Here are the factors that judges consider when deciding custody in NY: http://www.womenslaw.org/laws/ny/custody/how-custody-process-works/how-w…

Also, regarding division of property, often times “fault” of either spouse may not considered when the judge is dividing up property and spousal support unless it is what is considered to be “egregious” fault (extraordinary, shocking, etc).  An example of egregious fault may be if one spouse attempted to murder the other, for example. Then s/he may lose out on property division and other asset division.
