V asks if she can take things she paid for in the marriage and leave
In terms of your question about picking up things that you paid for, I cannot specifically advise you as to whether or not you can take certain items - only a lawyer who is familiar with your situation and with your state’s laws can advise you in this way. However, I will try to offer you some general information that I hope will be helpful to you. In general, marital property may be divided up during a divorce - sometimes, prior to a divorce, people who are separating may come to an agreement on what each person will take. Other times, one person who is leaving may take items that s/he feel belong to him/her and the other spouse may disagree – in those cases, the remaining spouse may ask the judge to order the return of certain possessions or may ask for the value of some or all of that the spouse felt should be divided up certain possessions and it would be up to the judge to decide whether or not to divide the property or let one spouse keep it. Or, more likely, the parties may come to an agreement as to which spouse gets to keep which property/possessions as part of the divorce negotiations. Here is some basic information about what is considered marital property and what, generally, is considered individual property in a divorce: USE SAMPLE LANG UNDER DIVORCE ‘MARITAL PROPERTY DIVISION’
