Custody & Kidnapping

.Dad has supervised visits; Mom letting him see kids unsupervised

You said that there were supervised visits ordered - do you know the circumstances under which those visits were ordered. Although I can’t speak to the facts of this particular situation, often times supervised visits may be ordered for various reasons: to protect the children, if the visiting parent is violent/abusive, if the visiting parent hasn’t seen the kids in a while, or for other reasons that are particular to the people involved. If the custodial parent is disregarding the order for supervision and something happens to the kids (for example, if the child is abused during a visit), you may want to ask an attorney if the custodial parent may be held partially liable for that or not. Also, you may want to ask an attorney if based on the facts of her situation, if both parents may be violating a court order and possibly face the penalties for that. Lastly, if the first parent was the one pushing for supervised visits or for full custody based on fear of the second parent and is now disregarding the supervised visitation order, you may want to ask an attorney if the other parent’s lawyer may have a good argument to perhaps say that the first parent may not really be afraid of the other since s/he lets him/her see the kids unsupervised.
