V wants to move with kids to another county and file for custody - UNMARRIED
Often times, if a parent is thinking of moving out of state with a child and the other parent objects, the parent may be worried that the other parent will accuse him/her of parental kidnapping. However, I am not sure if a person who wants to move within the the same state may face similar issues or not. Here is a link to STATE’s parental kidnapping laws: LINK You may want to talk to a lawyer who specializes in STATE custody matters for advice about whether or not moving to the place where you want to go to may bring up any issues with parental kidnapping. Another question for an attorney may be whether or not the new county where you are going to file for custody would have the power over custody matters regarding your child - or whether you may need to file in the county where the child had been living.
Another option that sometimes a person who is being abused may consider who wants to leave the home with a child is to file for an order of protection in court and to ask for temporary custody as part of the order.
