.I have a temporary custody order. Can I leave the state temporarily?

Just having a temporary custody order doesn’t necessarily mean that a person can leave the state although I cannot speak to your situation in particular. Often times, if people are in the middle of a custody case, it may not be proper for either parent to remove the child from the state without the judge’s permission. I can’t speak to the specific laws in STATE so you may want to talk to a lawyer before leaving the state and show the lawyer your temporary custody order to get some specific advice.

Also, if there is a temporary visitiation schedule, this is generally something that a custodial parent has to consider - whether s/he can still fulfill the visitation schedule if out of state. Failure of either parent to follow a visitation / custody order may lead to the other parent filing a violation petition asking for contempt of court.

If you are looking to move out of state for an extended period of time, you may want to talk to a lawyer to ask how to go about trying to modify the custody order to get permission to move. If it is not clear from your order whether you can leave the state temporarily, if you have a court date coming up, perhaps the judge may be able to clarify it for both parties as to what the limitations are about leaving the state.
