I am in the middle of a mediation/custody case. Can I travel out of state with my child?

Often times when parties are in the middle of litigation, there may be restrictions against either party leaving the jurisdiction (the state) with the child. In some states, the custody petition that a person files or is served with may even say that the child cannot be taken out of the court’s jurisdiction. Sometimes one party may have to get permission from the judge to take the child out of state during a court proceeding. I cannot speak to what STATE’s laws say about this so you may want to talk to an STATE custody attorney to see whether or not STATE has similar restrictions or not and to get advice as to what steps, if any, you should take before trying to leave the state.
