Does a protection order trump a parenting plan/custody order?

Although I cannot specially speak to your situation or the laws in STATE, in general, it is common that there may be an existing custody/visitation order and then one parent gets a protection order that ends up changing the rights of one parent that s/he got in the custody order. For example, a parent may have visits with a child but later a protection order orders the parent to stay away from the child, overriding the custody order. Or the custody order may allow for the parents to exchange the child at one parent’s house but later a protection order orders one parent to stay away from the other parent. Sometimes the protection order will specifically change the terms of the custody order and provide for a different form of child exchange, for example. In other situations, the respondent in custody order may have to file in court to modify the custody order so that s/he can still see his/her child and follow the terms of the protection order.

Again, I can’t speak to your situation and so for specific advice, you may want to show both orders to an attorney and ask for advice. Here is a link for finding a lawyer in STATE:LINK And here is information about orders of protection in STATE:
