Is there such a thing as rape by fraud or deception? (when the man lies to get V to have sex)
Generally, to prove a rape crime, there needs to be some sort of force, or a lack of consent by the victim due to age, coercion/duress, or inability to consent (such as if the victim were drugged or incapacitated). There is a concept of rape by deception, which often is raised when someone impersonates someone else so that the woman “consents” but thinks that the person is someone else (such as, for example, if a woman thinks she is with her boyfriend but it is really his twin brother pretending to be him). I do not know if there has ever been a case where lying in order to get someone to consent to sex has been prosecuted.
