Restraining Orders

Will RO that includes minor child expire for child when s/he turns 18?

In many states, a restraining order that involves a child will only last until the child’s 18th birthday. However, in other states, the order may expire at a later date (well after the child has reached 18). In those cases, a child who is the subject of a protection order who turns 18 may be able to file to have the order terminated as it relates to him/her (but the order may still be valid for anyone else named in the order). Sometimes the paperwork is called a motion to dismiss the order or something similar - I am sorry that I cannot speak to how this is handled in STATE. If the order was already issued by the court, you may want to read the order to see if there is an expiration date on the order or if it says anything about lasting only until the child’s age of majority. If not, you may be able to ask the court clerk at your local courthouse if there is a policy on this issue or you may be able to ask an attorney in STATE who handles protection orders who can advise you.
