Can an A be served while in rehab?
Although I can’t speak to your specific situation, in general, most states permit a respondent to be served with a petition for a protection order anywhere - in jail, in a hospital, at work, etc. I do not know if perhaps there may be any reason that a person might not be able to be served while in a rehab but you may want to confirm with an attorney to be sure. Sometimes, if there are unusual circumstances, a person may be able to ask a court to postpone a court date - I am not sure if someone at a residential treatment facility may be able to ask the court for an adjournment to postpone the case until s/he leaves treatment.
