Will a VAWA petition go on my husband's record?
The US Immigration website says that the “abuser will not be notified that you have filed for immigration benefits under VAWA” - you can find this information here on the USCIS (Immigration) website: http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7…
When you ask if it goes on his record, I imagine you are asking about his criminal record, right? In terms of what goes on a criminal record, although I cannot speak to the specific laws in STATE, generally a criminal record shows crimes a person was convicted of and in some instances it may show arrests as well. A VAWA petition is not an arrest and the Immigration system is separate than the criminal system. However, to find out if a VAWA petition may somehow get on a person’s criminal record, you would have to ask an immigration attorney who specializes in VAWA.
Here is more information on VAWA from our website, WomensLaw.org:http://www.womenslaw.org/laws_state_type.php?id=10270&state_code=US We strongly recommend that people do not file immigration petitions on their own. Here are links for lawyers in STATE and some that are national organizations that you may want to contact to find one that specializes in VAWA:
