Man asks how to get spouse deported; she came over on fiance (K-1) visa
Our website has information about domestic violence and so we don’t have information related to one spouse wanting to get another spouse deported. However, in general, a person doesn’t necessarily “get” another person deported. If the person overstays his/her visa or has no legal status, then that person can be subject to deportation by the government. Or if the person commits a crime or does something else that could subject the person to deportation, the government may act to deport that person.
In terms of a situation with a person who is on a fiance visa and later marries the fiance, generally, the US citizen spouse will file immigration papers for the spouse to get his/her green card. I do not know if you have done this or at what stage you are at with your spouse. In addition, if a person does not have legal status and his/her spouse will not sponsor him/her for a green card, there may be other alternatives for that person to gain legal status if s/he is abused by the US citizen or if s/he becomes the victim of a crime by anyone.
