V is applying for U visa and getting married. Is there waiting period to apply for new spouse's U visa?
I am not an expert in immigration law so I tried to do a little bit of research for you to give you some basic information. However, I strongly suggest talking to an immigration lawyer to find out specific info that would be relevant to you and to get advice.
In general, U-1 principal applicants can apply for U nonimmigrant status for spouses and children. If the principal (you) is under 21, s/he can also apply for his or her parents and unmarried siblings under 18. You would have to talk to an immigration lawyer to determine if there are any timing requirements for the marriage. You may want to ask an attorney if one relevant issue may be whether immigration thinks the marriage is a good faith marriage - I don’t know for sure. Also, I do not know if there are any required waiting periods, so this is another thing you may want to ask a lawyer.
If a lawyer tells you that you cannot apply for a new spouse for some reason, you may also want to ask a lawyer about applying for a family member at the time you adjust status (to get your “green card.”) and to see what would be the best strategy in your case.
