A U visa applicant cannot try to get his/her spouse legal status through the U visa if the spouse is the “abuser” (the person who committed the crime for which the U visa was entered). However, in general, it may NOT affect the U visa’s ability to get legal permanent residence status for himself/herself is s/he married the abuser.
