There can be a few different crimes that are related to secretly recording another person without his/her consent. I will talk about those first and then I will address other issues and options related to when the person who has the images or videos posts them on the internet or shares them with others. [ADJUST THIS LANGUAGE ACCORDING TO WHAT THE LANG OF THE CRIME SAYS:] Although the crime doesn’t specifically mention video recording or sexual acts, perhaps one may be able to make the argument to law enforcement that any words exchanged during the sexual acts that are recorded could come under communications that were supposed to be exchanged in a private setting (which is what the law is getting at trying to prevent).

Do you know worry that this person who recorded it will send it to others or post it online? Sometimes if a person has not yet committed a crime, such as distributing images, but the goal it to prevent it from happening, an individual may hire a lawyer for the purpose of sending a letter to the person to inform him/her of the law against distributing images along with a strict warning that the person will be reported to law enforcement if s/he does actually commit the crime or attempt to commit it.
