.What happens to my child if I die when the father is in prison/there is no father?

Although I am not specifically familiar with [STATE]’s laws on this topic, generally parents have first right to custody. If the other parent is not able to have custody or there is no father, do you think there is a relative who may want custody. If so, generally the relative may apply in court for custody and there may be a custody hearing for the judge to determine what is in the child’s best interests - if more than one relative applies, the judge may decide who is best suited to have the child. In terms of what would immediately happen to the child once the only parent passes away, do you think that one of your relatives might take the child into his/her home and then file for custody while s/he is staying there. If there is a specific relative of yours who you would like to be the one to take this role, perhaps you may consider talking to that person beforehand to express your desires. If no relative comes forward or the judge feels that the person fighting for custody is not fit to be the custodian, you may want to ask an attorney if this means that Child Protective Services could get involved to take the child into foster care – I am not sure of exactly what happens in this type of situation.
