Although I cannot speak to your situation, generally if one parent moves to another state, s/he may not be giving up his/her right to see the child just by moving. If there is a current visitation order, s/he may have to file to modify it especially if the parents can’t agree on a new schedule. Visitation may just have to be worked out to accommodate the distance. For example, perhaps when the child is young, the parent may have to come to the child’s hometown to visit the child. Once the child is older, perhaps the child may have to travel for weekends, summers, etc. If this is done in court, it may be decided either by an agreement between the parents or perhaps by the judge if the parents can’t agree.
