Do you currently have a custody order in court. If so, perhaps you may want to ask an attorney whether or not you can file to modify the order to ask that the father be given custody of the child. However, if the father refuses to accept custody, I do not know if a judge would force a parent to have custody of a child if that parent doesn’t want to raise the child - I am not sure how a judge would rule in that case. Again, you may want to ask an attorney if a judge may grant a parent custody who does not want it - if an attorney tells you that is not a possibility, you may want to explore other options with the attorney about how to help your child. Perhaps an attorney may tell you if your state has the option of, for example, putting your child in a treatment facility if there are certain issues that need to be treated (such as mental health issues, drug use, etc.) or perhaps there is a way to get help from the state through a court proceeding for a child that is out of control. In some states, it may be called a PINS petition (person in need of supervision) or something similar - I don’t know what it is called in STATE or if such an option exists.
