Why does my court case keep getting postponed?
NOTE: THIS IS FOR A SITUATION WHERE BOTH PARTIES HAD LAWYERS. IF YOU ARE NOT SURE IF THIS IS THE CASE, OR YOU KNOW THAT THE WRITER IS PRO SE, ADJUST THE LANGUAGE AS NEEDED TO REFLECT THAT:
You mentioned that your hearing has been postponed several times. Do you know why? Sometimes, a hearing might be postponed if the attorneys involved feel that they are close to negotiating a settlement that would make such a hearing unnecessary. Other times, each side might have requested a delay for its own reasons at various times - for example, an attorney might need time to gather more evidence, or a witness might not be available for trial on that date, or there might be a scheduling conflict. But in some cases, all of the delays come from only one party. If that is the situation, the problem might be litigation abuse.
Perhaps you might want to have a conversation with your attorney to see if you can find out what is happening to cause the delays and what the plan is going forward. Your attorney might be more comfortable giving you an idea of what the obstacles/solutions are in your particular situation than s/he would be giving you a generic timeline of how a generic case might go. Does that make sense? We have some suggestions on how to work with your lawyer that might be helpful in figuring out what to discuss.
