Do I have to accept service on behalf of my son?

I am not specifically familiar with STATE’s laws regarding service of process (as serving court papers is called). If this person is trying to sue your son and serve you at your home, do you think it is because the person doesn’t know where your son lives, works or can be found. If this is the case, and you don’t accept service, do you worry that your son will never know what he is being sued for and won’t have a chance to go to court to defend himself. Perhaps your son may want to talk to an attorney to ask about the pros and cons of avoiding service. He may want to ask an attorney whether if he avoids service, if the person suing him may not be able to proceed with the lawsuit or if that person may get a judgment against him on default. He may also want to see if the attorney may know whether the judge may have given permision for him to be served through other means (i.e., at his last known address, which may be your address).

You may want to ask an attorney and/or your son if you should give out your son’s address to the process server or not. I am not sure what the type of lawsuit is that he is being served with but you may want to call your local legal services office and ask your questions there.
