Definition of a non-DV restraining order (temporary injunction)

One possible option in some states is that as part of a civil court case, a party may be able to ask the court to issue an injunction (also called a restraining order), which can be a court order that prevents someone from acting in a certain way. Often times, these types of injunctions deal with behavior such as preventing someone from transferring assets, destroying or selling property, building a fence on a property line that is in dispute, or some other behavior that the court believes will cause irreparable harm if the injunction is not issued. This may be issued in a divorce before division of assets or in other cases where the judge wants to prevent someone from doing something that may harm/negatively affect the other party. Although the name of this order is a restraining order, it is generally completely separate than a restraining order based upon domestic violence and is often handled in a different court. Unfortunately, we don’t have any information on this type of civil court restraining order so I can’t give you more information on whether you can get one, how, and where.
