Chapter 26.10 Non Parental Actions for Child Custody

back to top26.10.034. Child custody petitions, orders, and decrees--Application of Indian child welfare act

(1) Every petition filed in proceedings under this chapter shall contain a statement alleging whether the child is or may be an Indian child as defined in section 4 of this act. If the child is an Indian child, chapter 13.--RCW (the new chapter created in section 35 of this act) shall apply.

(2) Every order or decree entered in any proceeding under this chapter shall contain a finding that the federal Indian child welfare act or chapter 13.--RCW (the new chapter created in section 35 of this act) does or does not apply. Where there is a finding that the federal Indian child welfare act or chapter 13.--RCW (the new chapter created in section 35 of this act) does apply, the decree or order must also contain a finding that all notice and evidentiary requirements under the federal Indian child welfare act and chapter 13.--RCW (the new chapter created in section 35 of this act) have been satisfied.
