arribaWhat is an Injunction Against Abuse? How do I get one?

If your relationship with the person who is abusive does not fall within any of those required to get a protective order, (such as a neighbor), you may still be able to get court ordered protection through an injunction against abuse, commonly referred to as a generic restraining order.  A "generic" restraining order can  be filed by anyone seeking protection.  It can provide many of the same protections as a protective order, including ordering someone to stay away from you, your family, your home, and so on.  However, you have to post a bond to file one.*

How do I get a generic restraining order?

To file an injunction against abuse, you can apply in the parish where the abuser lives, in the parish where you live, or in the parish where the abuse you are trying to prevent MAY occur. An injunction against abuse is good throughout the state, no matter what parish it was granted in.**

The process for obtaining an Injunction is basically the same as the one described on this site (for protective orders). The forms you fill out will be slightly different, so be sure to tell the clerk of court that you are seeking protection from abuse that is NOT domestic violence.  In other words, the abuse does not involve a family or household member. If granted, a Permanent Injunction never expires.
